1. Introduction

Revved Up Live Media, LLC d/b/a revveduptshirts.com (“Revved Up,” “we,” “us,” or “our“) respects your privacy. This Privacy Policy describes how we collect, use, and share information when you visit or use https://revveduptshirts.com/ (the “Site“) and related services (collectively with the Site, the “Services“). Terms not defined in this Privacy Policy are defined in our Terms of Service.

This policy applies to users in the United States. We do not operate in or market to the European Union (EU) or European Economic Area (EEA), and the Services are not directed to EEA users.

By accessing or using the Services, you agree to this Privacy Policy and our Terms of Service. If you do not agree, do not use the Services.

2. Information We Collect

2.1 Information You Provide to Us

  • Account and Order Data: When you place an order (including as a guest), we collect information such as your name, email address, phone number, shipping address, and order details.
  • Designer Data: If you apply to become a Designer, we may collect your name, contact information, biography/profile information, and other information you provide in connection with your application. If you are approved, we may collect payout-related information and tax forms as needed to pay you.
  • User Content: We collect Designs, shop images, and other content and information you provide to the Services.
  • Public Information. The Services may allow Designers to publish certain profile information, shop images, Designs, and Product listings. Any information you choose to make public through the Services may be viewed by others and may be indexed by search engines. Please do not post information you do not want to be public.
  • Communications: We store messages and communications you send to us (including customer support inquiries) and communications sent through the Services.
  • Payment Information: Payments are processed by third-party commerce and payment providers (such as Shopify and its payment processors). These providers collect payment details (such as billing information and payment card details). We do not store full payment card details; we may receive limited transaction information and tokenized records for accounting and customer support.

2.2 Information Collected Automatically

  • Log Data: Like most websites, we automatically collect information such as your IP address, browser type, device information, operating system, and referring URLs.
  • Usage Data: We collect information about how you interact with the Services, such as pages viewed, items added to cart, purchase history, and interactions with emails or marketing.

2.3 Cookies and Similar Technologies

  • Cookies: We use cookies and similar technologies for purposes such as enabling core Services functionality (e.g., shopping cart and session management), remembering preferences, analytics, and (where enabled) marketing and remarketing.
  • Analytics: We use Google Analytics and other analytics tools to understand how users use the Services and to improve performance.
  • Remarketing/Advertising: We may use information about your interactions with the Services (including purchase habits) to market or remarket our Products to you. Depending on the tools we use, this may involve cookies or similar technologies provided by third parties (such as Google).

2.4 Do Not Track and Opt-Out Preference Signals.

Some browsers offer a “Do Not Track” (DNT) signal. Because there is no consistent industry standard for DNT, we do not respond to DNT signals. Where required by applicable law and where technically supported, we may process certain opt-out preference signals as a request to opt out of targeted advertising or sharing.

3. How We Use Your Information

We use your information to:

  • Operate, maintain, and improve the Services.
  • If you are a Designer, create and market Products using your Designs.
  • Process and fulfill orders, including shipping, returns, refunds, and customer support.
  • Communicate with you about your orders, account, and service-related notices.
  • If you are a Designer, manage and effectuate Revenue Share payouts.
  • Detect, prevent, and investigate fraud, abuse, security incidents, and unlawful activity.
  • Provide marketing communications (email and, if enabled, SMS/text messages) and remarketing based on purchase habits and interactions with the Services.
  • Comply with applicable law and enforce our Terms of Service.

4. Sharing Your Information

We do not sell your personal information. We share information only in the following circumstances:

  • Service Providers: We share information with trusted third-party vendors who help us operate the Services, such as ecommerce and payment providers (e.g., Shopify and its payment processors), fulfillment and shipping partners (e.g., Printful), analytics providers (e.g., Google Analytics), customer support tools, and marketing services providers.
  • Legal Requirements: We may disclose information if required by law, subpoena, or to protect the safety and rights of Revved Up or others.
  • Business Transfers: If we are involved in a merger, acquisition, bankruptcy, reorganization, or sale of assets, your information may be transferred as part of that transaction.

Depending on your state of residence and the tools we use, certain disclosures to analytics or advertising partners may be considered “sharing” for targeted advertising under applicable law. See Section 7 (State Privacy Rights) for information on how to exercise opt-out rights where available.

5. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, process and fulfill orders, maintain business records, comply with legal obligations, resolve disputes, and enforce agreements. For example:

Order and transaction records may be retained for several years for tax, accounting, chargeback management, and legal compliance purposes.

Customer support communications may be retained to improve customer service and handle disputes.

Designer payout and tax records may be retained as needed to comply with tax reporting and auditing obligations.

If you request deletion, we will delete or de-identify information as required by law, but we may retain certain records as necessary for legal, tax, accounting, fraud prevention, and security purposes.

6. Security

We take reasonable measures to protect your information, including password-protected accounts and access controls. However, no transmission over the internet is completely secure, and we cannot guarantee absolute security. Please use strong passwords and maintain appropriate device security.

7. State Privacy Rights

7.1 California and Certain State Opt-Out Rights (Sale/Sharing/Targeted Advertising).

We do not sell personal information for money. However, depending on the tools we use (such as analytics and advertising/remarketing technologies), certain disclosures of information (including identifiers and online activity information) to third-party partners may be considered “sharing” or processing for “targeted advertising” under applicable state privacy laws.

Opt-Out. Where applicable, you may opt out of the sale/sharing of personal information and/or targeted advertising by:

(a) using our cookie preferences/consent tool (if available) to disable advertising/remarketing cookies; and/or

(b) emailing us at privacy@revveduptshirts.com with the subject line “Privacy Opt-Out” and the email address associated with your order/account.

Do Not Sell or Share Link (if used). If we are required to provide it, we will make available a “Do Not Sell or Share My Personal Information” link in the footer of the Site (or through our cookie preferences tool) that allows you to exercise these opt-out rights.

7.2 Generally. Depending on your state of residence (e.g., California, Colorado, Connecticut, Virginia, Utah, etc.), you may have specific rights regarding your personal information. These rights vary by state and may include:

  • Right to Access/Know: The right to confirm whether we are processing your personal information and to access a copy of that data.
  • Right to Correction: The right to request correction of inaccuracies in your personal information.
  • Right to Deletion: The right to request deletion of personal information we have collected from or about you.

  • Right to Non-Discrimination: The right not to receive discriminatory treatment for exercising your privacy rights.

How to Exercise Your Rights: To submit a request, contact us at privacy@revveduptshirts.com. We will verify your request as required by applicable law (for example, by confirming the email address associated with your order or account) before processing it.

Verification. We will verify your request as required by law, which may include confirming information associated with your account or order.

Authorized Agents (where applicable). In certain jurisdictions (including California), you may designate an authorized agent to make a request on your behalf. We may require proof of the agent’s authorization and may also require you to verify your identity directly with us.

Appeals (where applicable). If we deny your request, you may appeal our decision by emailing privacy@revveduptshirts.com with the subject line “Privacy Appeal.” We will respond to an appeal within the time required by applicable law.

8. Children’s Privacy

Our Services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will delete it and terminate access to the Services to the extent possible.

9. Your Choices

  • Account and Order Information: You may update information through your account (if available) or by contacting us.
  • Marketing Emails: You can unsubscribe from marketing emails using the unsubscribe link in the email.
  • Marketing Text Messages (SMS): If we send marketing text messages, we will do so in accordance with applicable law and generally only with your consent. You may opt out at any time by replying STOP (or following the instructions in the message). After you opt out, you may receive a final message confirming your opt-out. Message and data rates may apply. Message frequency may vary. If you need help, reply HELP or contact us at privacy@revveduptshirts.com. We may use service providers to send SMS messages on our behalf; those providers may process your phone number and message delivery data solely to provide messaging services to us.
